Within the framework of contractual relationships, Gegenwart Auktionen GmbH (hereinafter “we,” “us,” or “our”) as the controller within the meaning of Article 4(7) of the EU General Data Protection Regulation 2016/679 (hereinafter: “GDPR”) processes personal data of contractual partners or their employees and/or their bodies (hereinafter also collectively referred to as “you,” “your,” or “yours”). This privacy policy informs you about the details of the processing of your data.
2. What is personal data?
Personal data refers to all information relating to an identified or identifiable person, such as name, date of birth, address, but also the content of correspondence conducted in the course of the contractual relationship (hereinafter: “data”).
3. How is your data protected?
Your data is protected by appropriate organizational and technical measures. These measures relate in particular to protection against unauthorized, unlawful, or accidental access, processing, loss, use, and manipulation.
Despite our efforts to maintain an appropriately high level of care, we cannot rule out the possibility that information you disclose to us via the Internet may be used by other persons. Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission and/or unauthorized access by third parties (e.g., hacker attacks on email accounts or telephones) that are not caused by us.
4. For what purposes do we process your data and on what legal basis?
We process your data for the following purposes:
- To fulfill the contract concluded with you/your company or to fulfill pre-contractual measures and to process a contract, in particular:
- Purchase and sale as well as public auctions of movable property (in particular works of art);
- Valuation of works of art and other movable property;
- Production and dispatch of advertising material for the presentation of the various auction items;
- Auction announcements (analog and online);
- Conducting auctions;
- Settlement of accounts with buyers of auction items;
- Handling logistics;
- Customer service;
- Conducting our business;
- Compliance with legal requirements and industry standards;
- Marketing purposes.
Processing activities that are necessary for the performance and execution of the contract, for the conduct of our business, and for compliance with legal provisions are based on the legal grounds of Art. 6 (1) (b) and (c) GDPR.
The processing of your data for marketing purposes is based on our legitimate interest pursuant to Art. 6 (1) (f) GDPR.
5. Who receives your data?
We will only disclose your data if this is necessary for the fulfillment of the contract, if we are required to do so by law, if there is a legitimate interest in the transfer, or if you have given your consent. In any case, we will only pass on your data to the extent necessary for the respective purpose.
Possible recipients include:
- Buyers of auction items
- Tax advisors, auditors, and lawyers
- Banks
- Insurance companies
- Courts and authorities
Processors we use in particular:
- IT service providers
- Transport companies
- Photographers
6. How long will your personal data be stored?
In principle, we store your data until the contractual relationship has been fulfilled or terminated. In addition, we are subject to various legal retention obligations (e.g., tax law). Furthermore, we may retain your data for as long as legal claims in connection with your contract can be asserted. In the event of pending proceedings, your data will be retained until the conclusion of such proceedings.
7. Your rights in connection with the processing of your data
If we process your data on the basis of your consent, you have the right to revoke this consent at any time without giving reasons (Art. 7 (3) GDPR).
